The Supreme Court has issued an interim order against the government to halt all proceedings on the extension of the CA term. After the government registered the constitution amendment bill for a 3-month term extension of CA in violation of the November 25, 2011 verdict of the Supreme Court, the apex court issued the interim order following the preliminary hearing on the writ filed against the government’s move yesterday.

 

As per the order issued by a single bench of Chief Justice Khilraj Regmi, it is stated that the government’s move to extend the CA term once again despite the November 25 order of the court to promulgate the constitution by May 27 was a direct violation of the court’s previous order. Alternatives to go for fresh elections, people’s referendum or an appropriate constitutional provision are reminded in the statement given the failure to promulgate the constitution by May 27.

The Supreme Court’s interim order has closed all doors for the extension of CA’s term in a constitutional manner. It has also invited an automatic dissolution of the Constituent Assembly if the parties fail to endorse the constitution by the deadline of May 27.

 

Meanwhile, the SC in its another decision has issued a show cause notice in the name of Prime Minister Dr Baburam Bhattrai and Minister for Law Krishna Sitaula in response to a contempt of court petition filed against the governmnet’s move to extend the CA term. A single bench of Supreme Court Justice Kalyan Shrestha has ordered the duo to come up with their replies in person within the next seven days. RSS
